Judge Donald Thompson

486-judge-donald-thompson.jpgI never write about work, but the sordid tale of Judge Donald Thompson has pervaded the national news such that I feel obligated to note my connection. Thompson was today sentenced to four years in jail and ordered to pay $40,000 in fines for exposing himself when he ...um... pleasured himself with a pump while he presided over four trials in 2002 and 2003.

For those of you who are not aware, I am a practicing civil defense attorney in Tulsa which is immediately adjacent to Creek County and the city of Sapulpa where Thompson was a judge for almost 23 years. 487-convict-donald-thompson.jpgOver the years, I appeared before Judge Thompson on a number of motions. To the best of my knowledge and recollection...I lost every one of them. And, that's enough about that.

What amazes me, besides the un-freakingly-believable things he did, is that Thompson, 59 years old, married and father of three adult children, was given the opportunity early on to simply retire...no jail time, no probation, no fines, no penalty, just retire from the bench. He turned that down and, instead, risked 40 years in prison and $80,000 in fines and wound up with four years (eligible for parole after two), a $40,000 fine, loss of his $83,879 a year (a lot for Oklahoma) pension for life, registration as a sex offender and a good dose of national ridicule. Wow.

    I have seen first hand how crooked people can be. I have had my privacy violated been lied to by Richard Smotherman. Taken to jail with no bond for 5 days, while my daughter had to have surgery. I KNOW JUDGE THOMPSON IS INNOCENT, and so do alot of other people. I hope those who have done this to him realize some day how much harm they have caused so many innocent people.

    Just in case anyone reading this is unfamiliar with Angela McClanahan, who commented above that she "know[s] Judge Thompson is innocent," from the Sapulpa Daily Herald:

    "McClanahan was Thompson’s business associate, and sexually explicit photographs of the couple allegedly were found on the judge’s state-owned computer in his Sapulpa courthouse offices."

    "However, McClanahan failed to appear at the trial last July...A bench warrant was issued against McClanahan and she was arrested the same day in Sapulpa that Thompson was formally sentenced to four years in prison. McClanahan later was released after posting a $5,000 bond...the charge of indirect contempt of court McClanahan still remains and currently she is expected to appear before Creek County District Judge Douglas Golden at 1:30 p.m. Nov. 1."

    I have studied this case with great interest. I have personally interviewed many people who were involved with this case, including Ms. McClanahan and Donald Thompson himself. From my personal investigation, I am convinced that Donald Thompson was victim of blackmail by courtroom aides and a quiet grudge against Sapulpa Police Department.

    An article from "Tulsa Today," publish June of 2004, depicts the Sapulpa Police Department's animosity towards Mr. Thompson and its relation to his case.

    Tulsa Today has also learned that SPD conducted a search of the judge’s area while he was not at his office. That search, according to inside sources, produced the now infamous penis pump. At question is the authority of the Police Department to take action within the courthouse. The Creek County Courthouse is excluded from the city and patrolled by the Creek County Sheriff’s Office. The Judge’s chambers are therefore improper if not illegal for SPD to search.

    Multiple sources confirm to Tulsa Today that the pump was a gag gift given to Judge Thompson as a joke in the late 1990s.

    The allegation appears to be that Judge Thompson, in the middle of a crowded courtroom during one of the county’s most exhaustive and widely publicized murder trials, made personal use of the pump. The sources also indicate that members of SPD reported seeing “tubes” under the judge’s robe.

    The trial in question was of Kurt Vomberg, charged in the death of Skyla Brooks. That trial brought an onslaught of press attention to the courtroom where the Judge was alleged to have used the devise. How that could occur without everyone in the room knowing is unexplained as of this time.

    While bizarre, the story didn’t begin there. For years SPD appears to have been waging a quiet war against Judge Thompson and incidents include some open hostilities. Inside sources tell Tulsa Today that there has been a known department effort to “get him” [Judge Thompson].

    In one incident, officers arrived at the Judge Thompson’s home during a party for one of his teenage sons. The police reportedly ordered the Judge to stop a live band’s performance. The Judge agreed to reduce the volume of the music, but the officer insisted on having the band stop altogether.

    The Judge in attempting to resolve the dispute asked the officer to contact whoever had complained about the noise suggesting he and the complaining person could negotiate a reasonable outcome. Shortly after the police left, the Judge learned that officers were stopping persons coming and going to the party.

    In response, the Judge grabbed his video camera and went to the location where he began recording events. One officer reportedly approached the judge and asked if there was anything he needed. “No, I think I can handle a video camera by myself,” Judge Thompson is said to have replied.

    In another incident one of Thompson’s teenaged sons was arrested by the Sapulpa Police. When he went to retrieve his son and bond him out on an O.R. bond (typically presented by an attorney), Judge Thompson was reportedly refused access to his son.

    As the accumulated result of multiple incidents, tensions between Judge Thompson and the SPD are not unknown throughout the community. This incident appears to be the latest round in an ongoing contest of authority and control.

    Some observers question if Creek County can get much more bizarre and wonder what public risk may exist if the Sapulpa Police Department is operating on vendetta at this level of intellectual competence. Repeated attempts to reach Sapulpa Police Chief Jim Wahl for comment have been unsuccessful to date.

    It is not my intention that my post should change your mind or opinion of Mr. Thompson or the charges that he was found guilty for, but it is my intention to encourage you to continue to fight against corruption in our law enforcement agencies which continue to erode away at our society and make a mockery out of our judicial system which Donald Thompson had the utmost respect for.

    My question to you Mr. HKD is Who else did you interview in your exhaustive investigation? I can tell you that you did not interview me or any of the other witnesses in this case. Because of this, it is easy to see why your "study" of this case is so one sided and slanted in favor of a convicted sex offender. A jury of 12 (including 3 people who were personal friends of his) heard the evidence and found him guilty. The evidence was frankly overwhelming.
    I am a Sapulpa Police Officer and I personally witnessed this behavior and I take offense to you calling me "corrupt". The corrupt one is now in prison.
    Creek County and Sapulpa Residents don't have to worry about thier law enforcement as you suggest. They can rest comfortably knowing that we will take a stand against those who are corrupt, including public officials. There is no title a person has in front of thier name that puts them above the law....including judge, or police officer. If they are dirty, they will be prosecuted....period. (I recently investigated and had a Sapulpa Police Officer (now terminated) arrested on three felony counts and that case is pending)
    I had/have never had a problem with Mr. Thompson, and in fact considered him a friend on a professional level. It was obviously very disturbing to me that this happened, but it was not my fault.... he made those decisions for himself.
    I hope that when he is released he makes the most out of the rest of his life...I wish him no ill will.

    I don't know you but I think if your going to make posts on these sites, you should at least try to be fully informed and/or not slant your opinions.

    Wow are you a wanna be. Suprisingly I've never heard of all of your countless hours of interviewing. Post your opinion, not your fantasy. Even folks like you who never amount to anything of value may have opinions. Please feel free. But don't expect the rest of us to fall for your nonsense.

    Oh and by the way, the Judge WAS guilty and fully abused his position. He needs help and will most likely not accept it.

  8. The corruption that was going on here went much further and deeper than a couple of penis pumps, I think a book and a movie would be possible out of this corrupt hole.

    Folks being forced to use LOCAL attorneys or threatened with long jail terms. It was all a circle of power with the money staying in the hands of local attorneys. The judge was ring-leader.

    Angela tell how you met him in motels all around Sapulpa, tell how he personally pulled strings for your sisters criminal charges to dissappear. Even the court reporter that testified against him said she "was afraid she would be found dead in a ditch in Creek County for coming forward".

    Honest stand up people in the Sapulpa Police Dept. and a new Sheriff is what this county has needed for years and finally got in 2001. Then the crack started in their formation. The rest is history. Scum trying to protect SCUM !
